In accordance with the provisions of DL No. 24/2014, of February 14, and Law No. 94/96, of July 31, this document establishes the terms and conditions to be observed in the use of the website www.yoursmarket.store, as well as in the process of purchasing the products marketed there, made available to its users.

Thus, users of the site should carefully read the conditions and the privacy policy before using it, since by using it or placing an order, users are consenting to their binding to these conditions.

In case of disagreement with these conditions and privacy policy, users should not use the site www.yoursmarket.store.

These conditions may be changed freely and without any prior notice, in order to adapt them to the applicable legislation. As such, it is the responsibility of the users to read the Privacy Policy and the General Conditions periodically, since the provisions in force at the time of using the site and the conclusion of the contract (as defined here) will be applicable.

These general conditions of sale are agreed between Yours Market, headquartered at Rua Prof. Dr. António Joaquim Ferreira da Silva 1705, 3720-767 Vila de Cucujães, with NIF 517330490, – hereinafter “Yours Market” and any user who wishes to make a purchase through the website www.yoursmarket.store, hereinafter “User”.

1st Order

The user may place an order through the webpage www.yoursmarket.store, filling in all the mandatory fields, and must provide their personal data. By doing so, the user expresses their full and complete acceptance of the general conditions of sale, the prices, and the characteristics of the products contemplated in the order. All orders are subject to acceptance by Yours Market.

Orders are subject to stock availability. The non-existence in stock of the ordered products, or any other cause of inability to fulfill the order, will be communicated by Yours Market to the user. In this case, Yours Market will refund the user the amounts eventually paid, as provided for in article 19 of DL No. 24/2014, of February 14.

Yours Market reserves the right to, at any time, withdraw any product from the site www.yoursmarket.store, as well as to suppress or alter any material or content, not being responsible for such fact, before the user or third party, as well as for the unavailability of the product, in the terms referred to in clause 2 of this article.

2nd Execution of the Order

After confirmation of the full payment of the products, as well as the shipping costs, and without prejudice to what is stated in clauses 2 and 3 of article 1, the order will be completed within 30 days.

3rd Shipping Costs

When making a purchase at the Yours Market online store, you can choose one of the two methods of accessing the order: store pickup or delivery to the indicated address.

The delivery of orders in-store does not imply any shipping cost.

The delivery of orders to the user’s home, or to an address indicated by them for this purpose, will imply for them the obligation to bear the delivery costs, according to the amount of the products ordered and according to the area, in the following terms:

We only make deliveries of orders within the EU.

4th Price and Payment

In accordance with current legislation, the prices established on the site www.yoursmarket.store, must be understood in euros, with taxes and fees included, at the date of issuance of the corresponding invoice.

The applicable VAT rate will be the one in force in the Member State of the place of delivery, according to the orders placed.

Prices and specifications are subject to change without prior notice.

Yours Market declines any responsibility for possible errors published on the page www.yoursmarket.store.

In the event that the real price of the ordered product is higher than that on the page, the user will be contacted to accept or cancel the order.

In the event that the real price of the ordered product is lower than that presented on the site www.yoursmarket.store, the difference between the real value and the amount paid will be refunded to the user.

The user may use the following payment methods: Credit card, Apple Pay, Google Pay, and PayPal.

5th Transfer of Risks

The risks of the product will be borne by the user from the moment of delivery.

6th Right of Withdrawal and Return

The user may withdraw from the order, without indicating a reason, within 14 days from the date of the order, with a refund of the amount paid.

The shipping and return costs are borne by the user. Thus, in the case of cash on delivery, Yours Market may charge the user the expenses it may incur.

The right of withdrawal may be exercised by the user in any form permitted by law, and it is considered, in any case, validly exercised by sending the withdrawal information.

This provision does not affect the other rights granted to consumers by current legislation.

The right of withdrawal applies exclusively to products that can be returned in the same conditions in which the user received them, namely in the original packaging and with all documents.

After the return, Yours Market will examine the products and verify their conditions. If the products have been used beyond the simple opening of the packaging, or if they present damage, no refund will be made.

Responsibility for damages suffered by the products or their loss, during the return, is the sole responsibility of the user.

The intention to withdraw can be expressed through the form available on the website – Return Form. In case of doubts, please contact the customer support service by email at apoioaocliente@yoursmarket.store.

7th Defective Products

If, at the time of product delivery, the user considers that it is not in accordance with the provisions of the order, they should immediately contact Yours Market.

The collection of the product not in accordance with the contract conditions will be carried out by Yours Market, which will examine the product and, in the case of confirmation of non-compliance, will communicate by email or telephone to the user the replacement of the product, within a reasonable period.

The replacement of the product will, however, be subject to stock availability.

In the impossibility of replacement, the amount paid for the products will be refunded to the user, including delivery costs.

8th Refund of Amounts Paid

The refund of amounts paid, in cases of exercising the right of withdrawal and defective products, will be made through the same means that was used to make the payment, within 14 days.

9th Exchanges

Products purchased on the site www.yoursmarket.store can be exchanged.

If the user for any reason wishes to exchange their item, they just need to contact the customer support team informing this intention within 14 working days after the order.

The verification of the items available on the site for the exchange must be done.

Like the return processes, the items must meet certain state conditions, namely: The item must be in perfect condition, have no marks of use or any visible damage; Ensure that the item comes with the original label and, if applicable, brand accessories; Accompany the original bag/box, where the label with your shipping details is located. If you no longer have it, place an indication of the name or order number inside the bag.

10th Right of Free Resolution

The user has the right to freely resolve this contract within 14 calendar days, without the need to indicate any reason.

The deadline for exercising the right of free resolution expires 14 days from the day following the day of the conclusion of the contract.

In order to exercise your right of free resolution, the user must communicate to Yours Market, Rua Prof. Dr. António Joaquim Ferreira da Silva 1705, 3720-767 Vila de Cucujães, telephone +351 968 477 669, email apoioaocliente@yoursmarket.store their decision to resolve the contract by means of an unequivocal statement by registered letter sent by mail or to the email apoioaocliente@yoursmarket.store.

For the deadline for free resolution to be respected, it is enough that the communication regarding the exercise of the right of free resolution is sent before the end of the resolution period.

11th Effects of Free Resolution

In case of resolution of this contract, all payments made by the user will be refunded, including delivery costs (with the exception of additional costs resulting from the choice of a shipping method different from the less expensive normal shipping method offered by us), without undue delay and, in any case, no later than 14 business days from the date we are informed of your decision to resolve this contract. Refunds will be made using the same payment method used in the initial transaction, unless expressly agreed otherwise by the user; in any case, the user will not incur any costs as a consequence of such refund.

The refund may be withheld until we have received the returned goods, or until the user provides proof of sending the goods, whichever occurs first.

In the event of contract resolution, the user must return the good(s) to Yours Market without undue delay and no later than 14 days from the day the user informs us of the free resolution of the contract. It is considered that the deadline is respected if the user returns the goods before the end of the 14-day period.

The costs of returning the goods will be borne by them.

The user is only responsible for the depreciation of the goods that results from handling that exceeds what is necessary to verify the nature, characteristics, and functioning of the goods.

12th Responsibility

For all stages of access to the page www.yoursmarket.store, as well as the ordering process, delivery, and subsequent services, Yours Market only has an obligation of means.

Yours Market does not guarantee nor is responsible for any inconvenience or damage inherent to the use of the internet network, the breakdown of the service, external intrusion, or the presence of computer viruses, or any other case of force majeure.

Products will be described and presented on the site www.yoursmarket.store with the greatest possible accuracy. If, nevertheless, errors occur on the site www.yoursmarket.store, Yours Market is not responsible for such a fact.

The provisions of this do not affect the rights granted to users, relating to the withdrawal of the contract.

13th Processing of Personal Data

The information or data provided by users will be treated in accordance with what is established in the Privacy Policy.

By using the site www.yoursmarket.store, the user consents to the processing of the information and data referred to in the preceding number and declares that all the information they provide is true and corresponds to reality.

Personal data will be used by Yours Market for information, disclosure, and processing of orders.

The user is guaranteed the right of access, rectification, modification, or deletion of their personal data, simply by sending an email to apoioaocliente@yoursmarket.store.

Notwithstanding Yours Market proceeding with the collection and processing of data securely and preventing loss or manipulation, using the most advanced techniques for this purpose, we inform you that open network collection allows the circulation of personal data without security conditions, running the risk of being viewed and used by unauthorized third parties.

14th Viruses, Piracy, and Other Computer Attacks

Yours Market is not responsible for any damages or losses resulting from a denial of service attack, viruses, or any other technologically harmful or damaging program or material, that may affect the user’s computer, computer equipment, electronic, data, or materials, as a consequence of using the site www.yoursmarket.store, or downloading content from it or the contents to which it redirects.

15th Intellectual Property

All elements, sound or visual, of the site www.yoursmarket.store, including the underlying technology, are protected by copyright, trademarks, or patents.

The user who has a personal site and who wishes to place, for personal use, a simple direct link to the page www.yoursmarket.store, must necessarily request prior authorization from Yours Market. The authorization is only valid if granted in writing.

Any link or hypertext directed to the site www.yoursmarket.store, using framing or in-line linking techniques is formally prohibited.

In all cases, the use of any link, including those referred to in 2nd and 3rd of this, even if authorized, must be removed with a simple request to Yours Market.

16th Total Agreement

These general conditions of sale constitute the total agreement between Yours Market and the user. If one of the clauses of these conditions becomes null or without value, due to legislative change, regulation, or sentence, the same will be considered unwritten.

17th Unilateral Amendment of these Conditions

These conditions may be changed at any time. The user is subject to the policies and conditions in force at the time they are using the site www.yoursmarket.store or formalize their order, except when, by law or decision of government bodies, changes are made, with retroactive effect.

In the case provided for in the second part of the previous number, the changes will also affect the orders that the user has formalized under the conditions subject to change.

18th Applicable Legislation and Jurisdiction

Portuguese law applies to these conditions. Any dispute arising from these conditions will be submitted to the competent Portuguese court.

19th Alternative Dispute Resolution
